In the following scenarios discuss whether the student would be considered “qualified” under the ADA. If you are aware of a situation where qualification was an issue, share that scenario here for discussion.
a) A medical student with Asperger’s Syndrome was terminated from the medical program due to concerns with the student’s ability to provide for safe patient care. For example, in one situation, the student communicated information concerning a patient’s disease in a way that increased the patient’s anxiety. the student The student admitted to having communication problems with patients and other staff members. The student requested extensive accommodations, which the university denied as being expensive, time consuming, and inefficient in resolving the safety concerns, in other words an undue burden to the university.
b) A student with psychological disabilities requests accommodations that would allow him to leave group settings when her anxiety is elevated. Would this student be considered qualified to participate in an elementary education program? Are there other reasonable accommodations that would help him to be qualified?
c) A student with a learning disability and anxiety disorder who is studying sociology fails in taking a foreign language after attempting to take two classes and failing. The sociology curriculum requires three semesters of foreign language.
