Some employers have entire departments dedicated to safety, while other employers do not have the resources and must incorporate this into doing business. As discussed previously, failure to comply with regulations can be costly for a business. OSHA has different levels of violations and imposes various penalties for these violations. These cases can be costly to businesses and result in significant penalties.

To begin the activity, select a case that involves an OSHA penalty. Please label your sections and address the following:

  1. Locating and Interpreting Cases: Please provide the name and citation of the case and specify the facts in the case in a detailed and logical way.
  2. Analysis: What is the issue in the case? What is the holding in the case? What is an applicable statute, regulation, or case(s)? What did the court look at in making its decision?
  3. Practical Application: What processes did the employer have in place or should have had in place to prevent this from happening in the future? Please use a minimum of two references. APA formatting required of references is required.
  4. Ethical Application: Do you feel the court’s holding was a fair result?  Please list specific reasons to support your opinion. Please use a minimum of two references. APA formatting required of references is required.

Interpreting what happened in a case will help you determine what the law is and what is expected in the future. Be sure to read the case carefully when you determine what legal issue the court is considering. Also, include all relevant cases and statutes the court relied upon in reaching its decision.
